End-User License Agreement (EULA) / Digital Product License
Effective Date: December 29, 2025
This End-User License Agreement (“EULA”) governs your use of all digital products purchased or downloaded from Calicoberry Digital, a doing business as (“DBA”) of Calicoberry Co. (“company,” “we,” “our,” or “us”). By downloading, accessing, or using any digital product, you agree to be bound by this agreement.
1. License Grant
Subject to compliance with this EULA, you are granted a non-exclusive, worldwide, revocable license to use the digital products for personal and commercial purposes, as permitted under this agreement and any product-specific license terms provided at the time of purchase.
This license does not transfer ownership. The company retains all rights, title, and interest in the digital products, including all copyrights and intellectual property rights.
2. General License Restrictions
Unless expressly permitted in writing by the company, you may not:
- Resell, redistribute, sublicense, share, or make available digital products in their original, unmodified, or standalone form
- Sell or distribute digital products where the digital file, design, or pattern itself is the primary or sole value
- Use digital products to create competing digital assets, stock resources, pattern libraries, or design collections
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Claim authorship or ownership of the digital products or any substantially similar derivative works
You may:
- Modify, combine, or incorporate digital products into new designs
- Use digital products in personal or commercial projects that result in a finished end product, subject to the restrictions below
3. Seamless Pattern Products
The following terms apply only to digital products identified as seamless patterns (“Seamless Pattern Products”).
Permitted Uses
You may use Seamless Pattern Products to create physical or print-on-demand end products, including but not limited to:
- Apparel, accessories, home goods, stationery, wrapping paper, mugs, and similar items
- Fabric manufactured through providers other than Spoonflower
The seamless pattern must be incorporated into an end product in which the pattern is not the sole or primary value.
Prohibited Uses
You may not:
- Sell, share, or distribute Seamless Pattern Products as:
- Digital paper
- Seamless patterns
- Pattern tiles
- Pattern files or design assets
- Upload or use Seamless Pattern Products on Spoonflower, including for fabric, wallpaper, or any Spoonflower product
- Claim ownership, copyright, or authorship of Seamless Pattern Products
Manufacturing fabric using Seamless Pattern Products is permitted only through providers other than Spoonflower.
4. Digital Paper & Full-Sheet Design Restrictions (Critical)
The following terms apply to digital paper, full-page designs, and large single-sheet designs, regardless of size or resolution.
Prohibited Uses
Digital paper may NOT be used to create:
- Seamless patterns
- Repeating tiles
- Surface pattern designs
- Pattern systems or pattern files
This prohibition applies regardless of modification, including but not limited to:
- Cropping
- Rearranging
- Editing
- Repeating
- Extracting elements
- Exporting or saving as a tile or repeat
Creating a seamless or repeating pattern from digital paper constitutes unauthorized derivative use and is strictly prohibited.
Permitted Uses
Digital paper may be used only as-is within finished designs or physical/print-on-demand end products where it does not function as a repeatable pattern.
5. Product-Specific License Terms
Some digital products may include additional or alternative license terms provided on the product page, within the product description, or included with the product files.
If a conflict exists, the product-specific license terms control for that product only.
6. Revocation
Violation of this EULA may result in:
- Immediate termination of your license
- Revocation of access to purchased products
- Requirement to cease use of all derivative works
- Legal action to enforce intellectual property rights and recover damages
7. No Warranty
All digital products are provided “as-is”, without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
The company does not guarantee compatibility with any software, platform, or manufacturing service and provides no tutorials or technical support beyond download assistance.
8. Limitation of Liability
To the maximum extent permitted by law, the company shall not be liable for any damages arising from the use or inability to use the digital products, including lost profits, lost data, or indirect or consequential damages.
9. Changes to This Agreement
The company may update this EULA at any time. Continued use of digital products after changes are posted constitutes acceptance of the revised agreement.
